Copyright & DMCA Policy

We respect the intellectual property rights of others and expect the people who use Holakare to do the same. This policy explains how to notify us of claimed copyright infringement on Holakare — the apps and this website — and how counter-notification works, consistent with the Digital Millennium Copyright Act (17 U.S.C. § 512, "DMCA").

Content in Holakare is private to the household that entered it — it is not published publicly. We nonetheless review every complete notice we receive and remove or disable access to material that is the subject of a valid one.

1. Reporting copyright infringement

Send your notice to [email protected] with the subject line "DMCA Notice." To be effective under the DMCA, it must include substantially the following:

  • identification of the copyrighted work you claim has been infringed (or a representative list, if the notice covers multiple works);
  • identification of the material you claim is infringing, with information reasonably sufficient for us to locate it;
  • your contact information — name, mailing address, telephone number, and email address;
  • a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf; and
  • your physical or electronic signature.

When we receive a valid notice, we will remove or disable access to the identified material and take reasonable steps to notify the user who provided it.

2. Counter-notification

If material you provided was removed and you believe that was a mistake or a misidentification, you may send a counter-notification to [email protected] including:

  • identification of the material that was removed and where it appeared before it was removed;
  • a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  • your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which we may be found) and that you will accept service of process from the person who filed the original notice or their agent; and
  • your physical or electronic signature.

If we receive a valid counter-notification, we will forward it to the original complainant and may restore the removed material in 10–14 business days unless the complainant tells us they have filed a court action seeking to restrain the alleged infringement.

3. Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing — or that it was removed by mistake — may be liable for damages, including costs and attorneys' fees. Please make sure a notice or counter-notification is accurate before sending it.

4. Repeat infringers

We may suspend or terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
