Terms of Service

These Terms of Service ("Terms") govern your use of Holakare — the family medication and care tracker. "Holakare," "the Service," "we," "us," and "our" refer to the Holakare iPhone and iPad apps, its Apple Watch companion and widgets, this website, and the services behind them. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
1. Holakare is not a medical device
Holakare is a tool to help your household organize care. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Reminders, schedules, duplicate-dose warnings, summaries, and every other feature are organizational aids only — they can be wrong, late, or missed (for example, if a device is off, offline, or notifications are disabled), and they are no substitute for your own judgment or a clinician's. Always follow the instructions of a qualified healthcare professional and the labeling of any medication. Never use Holakare to decide whether a medication or dose is safe. In an emergency, call your local emergency number.
2. Who may use Holakare
You must be an adult — at least 18 years old, or the age of majority where you live — to create an account. Holakare is intended for adults managing their household's care. Adults enter and control all information, including any details about children in their household; children do not create or hold accounts.
3. Your account
You register with your email address; a new account is created when you confirm the verification link we email you, and you can optionally set a password afterward. You can also sign in with an emailed sign-in link. Because your email inbox is the key to your account, keep it secure — you are responsible for activity that happens under your account. Give us accurate information, keep it up to date, and tell us at [email protected] if you believe your account has been compromised. Using the app without an account ("guest mode") keeps your data on that device only, and these Terms still apply.
4. Your household and shared data
A household (family) is the unit that owns data in Holakare. Registering creates a household for your account; other caregivers join through single-use, expiring invite links. Understand what inviting means: every member of your household can see and edit the household's shared records — its patients, treatments, doses, medicines, visits, observations, and photos. Only invite people you trust with that information, and only enter information about another person (including children in your care) if you have the right or their permission to do so.
Members can leave a household, and the member who invited someone (or the household's creator) can remove them; the creator cannot be removed. Data contributed to a household belongs to the household's shared record and remains available to its remaining members after someone leaves.
5. Your content
The information your household enters — health records, notes, and photos — is yours. You grant us only the limited license we need to operate the Service: to host, store, transmit, back up, and display that content to your household's members and to you, on your instructions. We do not sell it or use it for advertising, as described in the Privacy Policy. You are responsible for the content you add — it must be lawful, and you must have the right to share it.
6. Free tier and Holakare Family
Holakare's core tracking is free, with limits — for example, on the number of active treatments and Care Episodes a free household can have, and on paid features such as care photos, exports, and household sharing. The paid subscription, Holakare Family, lifts those limits for your whole household: when any member has an active subscription, paid features are available to every caregiver in the household. Free-tier limits and the contents of each plan may change over time; the price and any free-trial terms are always shown in the app before you buy. If no paid plan is currently offered — for example while the apps are not available on the App Store — the free tier applies, and nothing in this section obliges you to buy anything.
- Billing. Subscriptions are purchased through Apple and billed to your Apple Account. Payment is charged at confirmation of purchase (or when a free trial ends).
- Auto-renewal. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel anytime in your device's Settings → Apple Account → Subscriptions.
- Free trials. If a plan includes a free trial, any unused portion is forfeited when you purchase a subscription, where applicable.
- Refunds. Purchases made through Apple are refunded by Apple under Apple's terms; we cannot issue App Store refunds directly.
- Lapses and cancellation. Ending a subscription does not, by itself, delete anything. Your household stays as it is: every member keeps their sign-in, and everything already recorded — including photos already uploaded and records above the free tier's limits — stays viewable and keeps syncing to every member's device. Who can change it narrows to one person: the household's original owner keeps full access, including editing, correcting, and deleting; any other caregiver becomes read-only until the owner renews. A single-caregiver household is unaffected, since its only member is already the owner. What also ends is creating what the paid plan gates — for every member, owner included: new caregiver invites, new photo uploads, and new Care Episodes and active treatments beyond the free tier's limits. Our pricing page describes the plans and these effects in more detail; if it ever differs from these Terms, these Terms govern. Section 10 explains when a household with no active subscription may eventually be deleted for inactivity.
7. Acceptable use
Use Holakare only for its intended purpose — managing your own household's care — and in compliance with the law. You agree not to:
- access or attempt to access another household's data, or probe, scan, or test the vulnerability of the Service;
- interfere with the Service — including overloading it, introducing malware, or circumventing rate limits, subscription gates, or security measures;
- scrape, harvest, or bulk-download data from the Service, or resell or provide the Service to third parties as a service bureau;
- reverse engineer, decompile, or disassemble the apps except to the extent a law expressly permits it despite this limitation;
- misuse invite links, impersonate others, or misrepresent your affiliation; or
- upload content that is unlawful or that infringes someone else's rights.
We may suspend or terminate access that violates these Terms or puts the Service or its users at risk.
8. Our intellectual property
The Service — including the apps, website, design, logos, and everything in them other than your content — belongs to us or our licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the apps on Apple devices you own or control, for your household's personal, non-commercial use, subject to these Terms and to Apple's App Store terms. If you send us feedback or suggestions, we may use them without obligation to you.
9. Copyright complaints
We respect intellectual property rights and respond to copyright complaints. If you believe content on the Service infringes your copyright, follow our Copyright & DMCA Policy, which explains how to send a notice and how counter-notification works.
10. Deleting your account; termination
You can stop using Holakare at any time, and you can permanently delete your account from within the app under Settings → Delete Account. Your sign-in is removed immediately. When the last member of a household deletes their account, the household's shared data is scheduled for permanent deletion and is purged after a short recovery window (currently 30 days); during that window you can contact [email protected] to restore an accidental deletion. We may also permanently delete households that have no active subscription and whose members have all been inactive for an extended period (at least 12 months, plus a grace period).
We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if we discontinue the Service; where reasonable, we will give you notice and a chance to export your data. Sections of these Terms that by their nature should survive termination (including sections 1, 5, 8, and 11–14) survive it.
11. Data, backups, and loss
We make routine backups of the household data we host so we can run the Service and recover from failures. If your household's data is lost, deleted, or corrupted in error — through a bug, a sync fault, a crash, or an accidental deletion — tell us as soon as possible at [email protected] and we will make reasonable efforts to restore it from the backups we hold. A restore may not include your most recent changes, and restoration cannot be guaranteed, so to the extent the law allows, those restoration efforts are your remedy for lost or corrupted data. (For deleting an account, the recovery window in section 10 applies. Deleting an account does not reach into those backups: they cannot be edited or selectively purged, and they age out on the fixed schedule described in the Privacy Policy.)
Holakare is not an archival or backup service, and some data never reaches us at all: using the app without an account ("guest mode") keeps everything on your device only, where we cannot recover it. We are likewise not responsible for loss caused by your device or its environment — a lost, stolen, damaged, or reset phone, the app being deleted, or the operating system clearing storage. Keep your own copies of information you cannot afford to lose — for example with the app's export features or your own records — and keep critical medical details somewhere besides Holakare (section 12).
12. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that data will sync without loss or delay, or that notifications and reminders will always be delivered. Keep your own records of critical medical information — do not make Holakare the only place a life-important detail lives.
13. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to the Service — and our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose or fifty US dollars (USD 50).
Some jurisdictions do not allow certain warranty disclaimers or liability limits, so parts of sections 11 through 13 may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law of your country of residence, and nothing in them affects your statutory rights as a consumer.
14. Indemnity
To the extent permitted by law, you agree to indemnify us against claims arising from your content or your breach of these Terms — for example, a claim that you entered or shared someone's information without the right to do so.
15. Apple App Store terms
The apps are distributed through Apple's App Store, and this section applies to them. These Terms are between you and us, not Apple; Apple has no obligation to furnish maintenance or support for the apps, and Apple is not responsible for addressing any claims relating to the apps — including product-liability claims, claims that the apps fail to conform to a legal or regulatory requirement, consumer-protection claims, or third-party claims that the apps infringe intellectual property rights. In the event the apps fail to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the apps. Apple and its subsidiaries are third-party beneficiaries of these Terms as they apply to the apps and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
16. Changes to the Service and to these Terms
Holakare is actively developed: features may be added, changed, or removed. We may also update these Terms — when a change is material, we will take reasonable steps to notify you (for example, in the app, on this site, or by email) before it takes effect. Using the Service after a change takes effect means you accept the updated Terms; if you do not agree, stop using the Service and delete your account.
17. Governing law and general terms
These Terms are governed by the law of the jurisdiction in which we are established, except that the mandatory consumer-protection laws of your country of residence remain unaffected and any rights they give you continue to apply. If a court finds part of these Terms unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and the Copyright & DMCA Policy, are the entire agreement between you and us about the Service.
